1. PAYMENT REGISTRATION:

1. Kiwi Kick Stars Programmes: Enrolling in a Kiwi Kick Stars Programme, secures a booking for the duration of the whole programme. Irrespective of attendance, payment is on a per programme basis and is expected by the date due on the invoice/email. Parents/caregivers and children are responsible for programme attendance.
1.2 Kiwi Kick Stars Programmes: Enrolling in a Kiwi Kick Stars Programme secures a booking for the days/times selected at the time of booking. Irrespective of attendance, unless prior notice that a child will be absent is given (min 24 hours), payment is still required and is expected by the date due on the invoice/email. Parents/caregivers and children are responsible for programme attendance.
1.3 Programmes Length: All Kiwi Kick Stars Programmes may vary in duration depending on location and programme type.
1.4 Late payment: Late payment constitutes a default under this agreement and Kiwi Kick Stars Ltd may withdraw children from programmes at their discretion. Additional administration fees may be charged to overdue accounts.
1.5 Indemnity: The parent/caregiver agrees to indemnify Kiwi Kick Stars Programmes against all costs, whether commissions, legal fees or otherwise, incurred by Kiwi Kick Stars Programmes or their duly Authorised Agents relating to the recovery of any monies that may be outstanding from time to time pursuant to the terms of this agreement.
1.7 Discontinued sessions: Kiwi Kick Stars Programmes reserve the right to discontinue any child for reasons including, but not limited to, inappropriate behaviour and non-payment of fees.
1.8 Note: Programme costs are reviewed annually, or as reasonably required, and at least one month’s notice, where possible, will be given of any change in price.

2. REFUNDS:

2.1 Kiwi Kick Stars Missed Sessions: No refund will be given where a session is missed or for early withdrawal from sessions during the term.
2.2 Kiwi Kick Stars Cancelled Sessions: If a session has to be cancelled and a catch-up session is not available, that fee will be carried forward and credited to the next term.
2.3 Kiwi Kick StarsHoliday Programme Missed Sessions: No refund will be given when a session is missed unless Kiwi Kick Stars Ltd has been contacted and advised of a child’s absence a minimum of 24 hours (or as set out in programme specific booking information) before the session commences.

3. PRIVACY AND COPYRIGHT:

3.1 Advertising: Kiwi Kick Stars Ltd programmes will occasionally video / photograph sessions and may use video footage or pictures for promotional or training purposes. You agree to your child’s image/s being used, unless written notification to the contrary is provided at enrolment. If any images are going to be used more widely you will be contacted and an agreement arranged.
3.2 Copyright: Children/Parents/Caregivers undertake not to make copies of any Kiwi Kick Stars Ltd Programme material, and/or use our intellectual property rights and content unless authorised to do so by Kiwi Kick Stars Ltd Head Office in writing.

4. RAIN POLICY

We do not cancel our sessions due to weather. Auckland weather is very fickle. It can be raining at 3.00 pm and bright sunshine by 3.15 pm. For this reason we run our sessions regardless. If conditions become too difficult we may hold, stop the session and go undercover.

Please note that football is primarily a winter sport and rain is not considered a safety hazard.

If the Met Service has issued a Severe Weather Warning we will review the situation and let parents know at least 2 h before the session starts.

We recommend parents to pack raincoats, jumpers and an extra set of cloth as if it is raining we will be likely to play on... the FUN doesn't stop.

5. GENERAL:

5.1 I consent to my child participating in/attending activities arranged by Kiwi Kick Stars Ltd Programmes, as well as travel by private vehicle or public transport/alternative transport services as may be used from time to time to advertised programme outings.
5.2 Belongings: Kiwi Kick Stars Ltd takes no responsibility for any loss or damage to children’s property while in our programmes.

6. CHILD HEALTH AND SAFETY

6.1 Medical information: In the interests of the child’s well-being, whilst in the care of Kiwi Kick Stars Ltd programmes, the programme must be informed of any medical or other condition affecting the child. This information should be included in your Enrolmy online account, and update Kiwi Kick Stars Ltd staff if conditions develop or change.
6.2 Kiwi Kick Stars Ltd is not responsible for children outside of the agreed programme time or for a child making their way to and from a programme venue. Where a child is attending any Kiwi Kick Stars Ltd programme, the ‘Drop Off/Pickup of Children’, ‘Children Not Arriving at the Programme When Expected’ and ‘Children Not Collected at the End of the Programme’ Policies & Procedures will apply.
6.3 Health and Safety Emergencies: In an emergency situation where your child needs medical attention, staff will ensure that every effort possible is made to get hold of the parents/caregivers/emergency contacts. If contact is unsuccessful, I authorise any person (acting through the staff and employees of Kiwi Kick Stars Ltd Programmes) in the event of an accident or illness to my child, to take all such steps as may be necessary for the proper treatment and care of my child (as advised by a duly qualified and registered medical practitioner).
6.4 Parents/caregivers are expected to be able to collect their child at any time if they become unwell, jeopardise the safety of other children or staff at the programme, or are identified as a health risk to other children or staff at our programme.
6.5 Kiwi Kick Stars Ltd programmes are committed to the recognition and prevention of abuse of children within our programmes and the community and support the roles of statutory agencies such as the Police and the Ministry for Vulnerable Children (Oranga Tamariki).

7. PRIVACY POLICY

We respect your privacy and value your relationship with us. This privacy policy describes how we collect and use personal information collected on the Site.

We suggest that you frequently review the privacy policy to ensure that you fully understand how your personal details will be used and that you are aware of any changes we have made from time to time to this privacy policy.

• We do not need any personal information if you simply browse the Site, we’ll just check out some pretty basic information, including the computer IP, browser and country. This really helps us improve your experience and our services to you.
• If you intend to register to use the services we provide, we may ask you to provide certain personal information that will be used to identify you, and to enable us to communicate with you, either online or offline. We may require information such as your email address, postal address, name, mobile number, credit card details, as well as additional information we need about your child(ren) to ensure we have everything we need to help with the safe use of our services. All these personal details will be stored and kept in strict confidence, subject to the terms of this Privacy Policy.
• We may also contact you to seek your comments about our services and notify you about important changes made to the Site or our services.

7.2 Storage, access and correction
• As required by the Privacy Act 1993, we follow strict procedures when storing and using the information you provide. We are dedicated to keeping personal information secure.
• You have rights of access to, and correction of, personal information that we hold about you. You may correct or change the information collected at any time and as often as necessary. To do so, simply log in and update your online account, or alternatively get in touch using the “Contact Us” option on the Site.
• You can also make choices about whether you receive promotional communications from us by following the ‘unsubscribe’ instructions included in our communications.

7.3. Use of your information
• We may use your personal information:
a) To share with our employees, and the employees of the service you use, to help administer your account and to communicate with you as required for the use of the services.
b) To monitor your use of our service, for the purpose of improving all aspects of our services, and ensuring that our service is not abused nor used wrongfully.
c) To provide you with news, updates and promotional material that we believe may be useful or of interest to you.
d) To comply with any statutory or regulatory obligations or applicable rules or guidelines requiring disclosure or use of the information. This includes, but is not limited to, the following government organisations: The Ministry of Social Development, Oranga Tamariki, Worksafe, The Ministry of Primary Industries, The Ministry of Education, The Ministry of Health, Inland Revenue Department.
e) To assist any law enforcement or governmental agency in the performance of their proper functions, if we reasonably consider disclosure or use of the information to be necessary for that purpose.
f) In consultation with the school the programme or session booking is connected to, if we consider it necessary to assist the health and safety or wellbeing of an individual or others.
g) For any legitimate purpose in connection with our business.
h) To compile statistical and analytical reports for marketing purposes on the use of our service by all of our customers and end users, provided that such reports do not identify individual customers and end users.

7.4. Changes to our privacy policy
• We may change and update our privacy policy from time to time by updating this posting. Any such change and/or update of our privacy policy will take effect when it is posted on the Site. You are therefore strongly recommended to review our privacy policy whenever you use the Site.

8. CHILD PROTECTION POLICY

Acknowledges its responsibility to safeguard the welfare of every child and young person who has been entrusted to its care and is committed to working to provide a safe environment for all members.

A child or young person is anyone under the age of 18 engaged in any  Kiwi Kick Stars football activity.

We strive to ensure a child’s protection with respect to best practices, policies and procedures

8 .1 The key principles of Kiwi Kick Stars child protection policy are that:

• The child’s welfare is, and must always be, the paramount consideration

• All children and young people have a right to be protected from abuse regardless of their age, gender, disability, culture, language, racial origin, religious beliefs or sexual orientation

• All suspicions and allegations of abuse will be taken seriously and responded to swiftly and appropriately

• Working in partnership with other organisations, children and young people and their parents or carers is essential.

8 .2 Safe Environment :

Kiwi Kick Stars acknowledge that every child or young person who plays or participates in our activities should be able to take part in an enjoyable and safe environment and be protected from poor practice and abuse.

Kiwi Kick Stars recognises that this is the responsibility of every adult involved in our programme

Kiwi Kick Stars has a role to play in safeguarding the welfare of all children and young people by protecting them from physical, sexual or emotional harm and from neglect or bullying.

It is noted and accepted that child protection applies to everyone in football whether in a paid or voluntary capacity. This includes those who are a volunteer, match officials, and football coaches.

8 .3 practice for child protection:

Kiwi Kick Stars endorse and adopt best practices for child protection and for recruiting volunteers and may:

• Develop a role profile

• Request identification documents

• As a minimum meet and chat with the applicant(s) and where possible conduct interviews

before appointing

• Request and follow up with two references before appointing

• Require a recognised Police Check where appropriate

All current Kiwi Kick Stars members with direct access to children and young people may be required to complete a recognised Police Check.

If there are concerns regarding the appropriateness of an individual who is already involved or who has approached us to become part of Kiwi Kick Stars guidance will be sought from appropriate sources. It is noted and accepted all decisions will be made in the best interests of children and young people.

It is accepted that Kiwi Kick Stars aims to prevent people with a history of relevant and significant offending from having contact with children or young people and the opportunity to influence policies or practices with children or young people. This is to prevent direct sexual or physical harm to children and to minimise the risk of ‘grooming’ within football.

Any adult or young person with concerns about a colleague can ‘whistle blow’ by contacting a Member of staff of director.

9. Welfare Officer (WO):

Kiwi Kick Stars has appointed a Club Welfare Officer (WO). The WO is the first point of contact for all club members and parents or guardians regarding concerns for the welfare of any child or young person. They will liaise directly with the appropriate authorities. They will also play a proactive role in increasing an awareness of poor practice and abuse amongst club members.Kiwi Kick Start acknowledge bullying as a category of abuse.

Bullying of any kind is not acceptable at our club. If bullying does occur, all participants, parents or guardians should be able to tell and know that incidents will be dealt with promptly.

Incidents need to be reported to the WO, a member of the coaching staff.

Code of Conduct:

Codes of conduct for participants, parents or spectators and coaches have been implemented by Kiwi Kick Stars.

In order to validate these codes of conduct the club has clear sanctions to deal with any misconduct at club level and acknowledges the possibility of potential sanctions which may be implemented in more serious circumstances. All prospective members can have access to these codes.

10. CODE OF CONDUCT

The purpose of this Code of Conduct is to encourage fair, ethical treatment of all persons and organisations that come under the umbrella of Kiwi Kick Stars.

Obviously some sections of the Code will be more applicable to some persons and groups than others.

All persons will agree to abide by the Kiwi Kick Stars Code of Conduct and acknowledge that any breach of the Code of Conduct, or any part of it, may result in disciplinary action under the Kiwi Kick Stars Constitution, Regulations and Policies.

The following Code of Conduct applies to all Kiwi Kick Stars members and persons participating in Kiwi Kick Stars activities or events.

As a Kiwi Kick Stars Participant and/or participant you should meet the following requirements with regard to your conduct during any Kiwi Kick Stars sanctioned activity:

  • Respect the rights, dignity and worth of others.

  • Be fair, considerate and honest in all dealings with others.

  • Accept responsibility for, your actions.

  • Make a commitment to providing quality service and performance.

  • Be aware of, and maintain, an uncompromising adherence to, standards, rules, regulations and policies.

  • Operate within the Constitution, Regulations, Policies and Procedures of Kiwi Kick Stars

  • Understand the possible consequences of breaching the Kiwi Kick Stars Code of Conduct.

  • Immediately report any breaches of Kiwi Kick Stars members to the appropriate authority. Comply with any and all applicable national or local legislation.

  • Refrain from any form of abuse towards others.

  • Refrain from using any obscene language.

  • Refrain from any form of harassment towards others including via social media.

  • Refrain from any form of discrimination towards others including via social media.

  • Refrain from any form of victimisation towards others including via social media.

  • Reject corruption, drugs, racism, violence and other dangers to our sport.

  • Promote the interests of sport and football.

  • Provide a safe environment for the conduct of activity in accordance with Kiwi Kick Stars policy.Show concern and caution towards others who may be sick or injured.

  • Be a positive role model.

  • Do not provide comment to any media, or publish any comment (including on any website), on behalf of Kiwi Kick Stars.

  • Do not speak to any media in a negative way, or publish any negative comment (including on any website) regarding Kiwi Kick Stars.

  • Never act in any way that may bring disrepute or disgrace to our members, its directors, coaching staff and/or its sponsors, potential sponsors and/or partners.

  • Do not participate (or benefit from assisting others involved) in sports betting or gambling activity associated  with Kiwi Kick Stars.

  • Kiwi Kick Stars expects all participants, supporters, advisors, staff and associates of Kiwi Kick Stars to abide by a Code of Conduct that upholds the principles and values of the organisation and the Kiwi Kick Stars Member Protection Policy.

  • Members should recognise that at all times, they have a duty of care to all  participantsin any activity during Kiwi Kick Stars programmes or events.

11. Coach will:

Respect the rights, dignity and worth of every individual player as a human being and:

  • Treat everyone equally regardless of gender, disability, ethnicity or religion.

  • Respect the developmental stage and goals of each participants in order to help each participant to enjoy their activity and support their social, mental and physical Development

  • Maintain high standards of integrity.

  • Operate in the spirit of fair play, while encouraging participants to do the same.

  • Not disclose any confidential information relating to their players without written prior consent.

  • Be a positive role model for the programme and sport and act in a way that projects a positive image of coaching viz:

  • Provide all participants with the equal attention and opportunities they deserve.

  • Ensure the time spent with their participants is a positive experience.

  • Be fair, considerate and honest with players.

  • Encourage and promote a healthy lifestyle – refrain from smoking, drinking alcohol and engaging in poor lifestyle choices around players.

    Show professional responsibility:

  • Display high standards in language, manner, punctuality, preparation and presentation.

  • Display control, courtesy, respect, honesty, dignity and professionalism to all involved within the sphere of sport - this includes opponents, coaches, officials, administrators, the media, parents and spectators.

  • Encourage their players to demonstrate the same qualities.

  • Be professional and accept responsibility for their actions.

  • Refrain from initiating a relationship with a player and also discourage any attempt by a player to initiate a sexual relationship with them, explaining the ethical basis of the refusal.

  • Accurately represent personal coaching qualifications, experience, competence and affiliations.

  • Refrain from criticism of other coaches.

    Make a commitment to providing a quality service to participants in Kiwi Kick stars programmes:

  • Seek continual improvement through ongoing coach education and other personal and professional development opportunities.

  • Provide players with planned and structured training programmes appropriate to their needs and goals.

  • Seek advice and assistance from professionals when additional expertise is required.

  • Maintain appropriate records.

Provide a safe environment for training and competition:

  • Adopt appropriate risk management strategies to ensure that the training and/or competition environment is safe.

  • Ensure equipment and facilities meet safety standards.

  • Ensure equipment, rules, training and the environment are appropriate for the age, physical and emotional maturity, experience and ability of the players.

  • Show concern and caution toward sick and injured players.

  • Allow further participation in training and competition only when appropriate.

  • Encourage players to seek medical advice when required.

  • Provide a modified training programme where appropriate.

  • Maintain the same interest and support toward sick and injured players.

  • Protect players from any form of personal abuse.

  • Refrain from any form of verbal, physical and emotional abuse towards players.

  • Refrain from any form of sexual and racial harassment, racial vilification and harassment on the grounds of disability.

  • Ensure that any physical contact with players is appropriate to the situation.

  • Be alert to any forms of abuse directed towards players from other sources while in their care

12. Participants will:

  • Play to enjoy and developed but play fair.

  • Never argue with or verbally abuse an official; observe the Laws of the Game.

  • Accept defeat with dignity.

  • Refrain from criticism of other coaches.

  • Conduct themselves in a sportsman-like manner and respect fellow players, coaches, managers and referees and the achievement of opponents.

  • Not bully or take unfair advantage of another competitor.

  • Cooperate with their coach, manager, team mates and opponent

    In addition, Players in Kiwi Kick Stars programmes/events will:

  • Refrain from possessing and/or consuming prohibited substances while in Kiwi Kick Stars activities/events.

  • Not consume or purchase alcohol and tobacco while in Kiwi Kick Stars activities/events.

Parent/Guardian will:

  • Agree to abide by the Code of Conduct.

  • Remember that children participate in Kiwi Kicks Stars Programmes and events for their enjoyment, not the parents.

  • Encourage children to participate and not force them.

  • Focus on the child’s efforts and enjoyments rather than winning or losing.

  • Encourage children always to take part in the activities/events according to the rules and to settle disagreements without resorting to hostility or violence.

  • Never ridicule or yell at a child for making a mistake or losing a competition.

  • Remember that children learn best by example.

  • Support all efforts to remove verbal and physical abuse from sporting activities.

  • Respect coaches/officials’ decisions and teach children to do likewise.

  • Show appreciation for coaches, officials and administrators.

Kiwi Kick Stars expects all employees, members, referees, administrators, participants, coaches, players, volunteers and parents or guardians to understand the possible consequences of breaching the Code of Conduct and ensure that they abide by the Code.

Any serious breaches of this Code of Conduct or persistent violations of any aspect of the Code of Conduct, by any of the above, may result in any of the following being imposed: 

  • Participants being excluded from the programme/event with no right to be refunded.
